Clear Channel Vows "Swift And Appropriate Disciplinary Action"

With Eliot Spitzer's Sony BMG settlement, eyes are now being turned to radio to see if there is any fallout at the stations implicated in his payola investigation. Among the companies that were served subpoenas, only Clear Channel has commented on yesterday's events.

A Clear Channel spokesperson told FMQB, "We are cooperating fully with Mr. Spitzer's office. Clear Channel has extremely strict internal policies against payola; so strict that we severed ties with independent promoters in early 2003 to avoid even the appearance of impropriety. We investigate any allegation of this nature. The allegations made today will be fully investigated and any wrongdoing will be met by swift and appropriate disciplinary action."

That statement echoes one made in February of this year when Clear Channel confirmed the company "has received a subpoena from the New York Attorney General's office and is cooperating fully with the investigation into the industry's use of independent promoters and associated allegations of pay for play." At that time, the nation's largest radio corporation also noted that "in April 2003, Clear Channel voluntarily severed all ties with independent promoters to avoid even the appearance of impropriety, and we are confident the investigation will show the company is in full compliance with the law."

Another person weighing in on yesterday's revelations was Wisconsin Senator Russ Feingold, who released a statement saying, "I was pleased to hear that New York State Attorney General Eliot Spitzer has come to a settlement with Sony BMG Music Entertainment. The Attorney General's investigation found that record labels had been regularly making payments or providing gifts to radio stations or their employees in exchange for airplay. As part of the settlement, Sony will halt the practice of making payoffs to radio stations and provide full disclosure of all items of value provided to radio stations. I have long been concerned about these payola schemes, which combined with increasing concentration and vertical integration in the radio industry, have the strong potential for limiting creativity, localism and diversity on our airwaves. I have introduced legislation in the past to promote competition in the radio and concert industries and, while this settlement is a step in the right direction, it provides even more evidence that it is time for Congress to address these issues at a national level."
